Judge Sets Deadline for New H-2A Farmworker Wages

A federal judge in California has given the U.S. Department of Labor until Dec. 30 to establish a new wage scale for seasonal foreign farmworkers.
U.S. District Judge Kirk Sherriff of Fresno signed the order Oct. 2, setting the deadline after ruling in August that wages established by the Trump administration last year were too low. He ordered the department to promptly replace the rates.
United Farm Workers sued the U.S. Department of Labor in late 2025 over an interim final rule that overhauled how wages are set for agricultural workers in the H-2A temporary agricultural visa program. Sherriff declined to immediately block the department from implementing the rule but ordered it to develop a revised wage-setting formula.
