The People V. Wayne Hsiung – Appellate Opinion Issued

On April 30, the 1st District Court of Appeal in California issued its opinion in the appeal of animal activist Wayne Hsiung. The court overturned two of his three convictions. While rejecting his argument that the necessity defense justified trespassing and the removal of birds from Sonoma County egg and duck farms, the court did rule that the jury should have been allowed to consider whether Hsiung believed his conduct was lawful, even if that belief was mistaken.
