California Farm Bureau Files Comments on Proposed Labor Department Joint Employer Rule

On June 19, California Farm Bureau submitted formal comments in support of a proposal from the Wage and Hour Division of the U.S. Department of Labor. The proposed rule would simplify the joint employment test under the Fair Labor Standards Act, Family and Medical Leave Act, and Migrant and Seasonal Agricultural Workers Protection Act.
Our comments noted the growth of farm labor contractors and the overall worker footprint in California. While existing state law would still factor into employment status, it would likely clean up and simplify federal regulatory obligations that persist for many. The Trump administration attempted a similar rule change late in its first term, but litigation and other work effectively reversed the attempted change.
