EPA Issues Updated Guidance on Right to Repair

In early February, the U.S. Environmental Protection Agency announced updated guidance relating to an ongoing “right to repair” barrier. The guidance clarifies that the Clean Air Act permits temporary overrides of emission control systems for the purpose of repairing nonroad diesel engines with advanced emission control technology and diesel exhaust fluid system repairs. The clarification intends to take away manufacturer claims that the Clean Air Act prevents users from conducting maintenance themselves on such systems.
